Acceptable Use Policy

This Acceptable Use Policy outlines the rules and guidelines for using TextileDesign. By using our service, you agree to comply with these rules.

1. Policy Overview and Scope

This Acceptable Use Policy ("AUP") defines the mandatory rules, guidelines, and restrictions for using the TextileDesign platform, API, and associated services. By accessing or using our services, you agree to adhere completely to this AUP. This policy is designed to ensure a safe, lawful, and respectful environment for all users, protect intellectual property, and prevent the abuse of our AI generation capabilities. We strictly enforce this policy through automated monitoring, manual review, and user reporting mechanisms.

2. Prohibited Content: Illegal and Dangerous Activity

You are strictly prohibited from using the Services to generate, promote, or distribute content that involves or facilitates illegal acts. This includes, but is not limited to: terrorism; the manufacturing or use of illegal weapons, explosives, or controlled substances; human trafficking; organized crime; child sexual abuse material (CSAM) or any exploitation of minors; and detailed instructions on how to commit violent crimes or cyberattacks. Any violation in this category will result in immediate account termination and reporting to law enforcement authorities.

3. Prohibited Content: Hate Speech and Harassment

You may not use TextileDesign to generate content that promotes discrimination, hatred, or violence against individuals or groups based on race, ethnicity, national origin, religion, sexual orientation, gender identity, age, or disability. You are also prohibited from creating content intended to harass, bully, threaten, or intimidate individuals, including the creation of non-consensual deepfakes, malicious caricatures, or targeted abuse.

4. Prohibited Content: Violence and Gore

The generation of excessively violent, gory, or grotesque imagery is not permitted. This includes realistic depictions of extreme physical injury, torture, mutilation, death, or animal abuse. While artistic interpretation of conflict or horror may be permitted within reason, content designed primarily to shock, disgust, or gratify sadistic tendencies violates this policy.

5. Prohibited Content: Sexual and Explicit Material

You may not use the Services to generate pornographic material, sexually explicit content, or imagery depicting non-consensual sexual acts. This prohibition applies to photorealistic depictions as well as highly explicit illustrations. The generation of non-consensual intimate imagery (NCII) or "revenge porn" of real individuals is a severe violation that will result in immediate termination and potential legal referral.

6. Prohibited Content: Misinformation and Deception

You are prohibited from using the Services to generate content intended to deceive or mislead the public on matters of significant concern. This includes: generating fake news, synthetic media depicting events that never occurred, deepfakes of political figures or public officials designed to manipulate elections or public opinion, medical misinformation, and content designed to facilitate fraud, phishing, or financial scams.

7. Intellectual Property Rights and Input Material

You must respect the intellectual property rights of others. You may not upload reference images, use text prompts, or generate content that infringes upon existing copyrights, trademarks, or rights of publicity. You may not use the platform to deliberately mass-reproduce the distinctive, recognizable style of a living artist without their permission, or to generate unauthorized merchandise of protected franchises.

8. Prohibited Conduct: System Abuse and Automation

You may not engage in any activity that disrupts, degrades, or abuses the TextileDesign infrastructure. This includes: employing unauthorized automated scripts, bots, or scrapers to access the service; attempting to bypass, disable, or reverse engineer safety filters and content moderation systems; performing denial-of-service attacks; or exploiting bugs for unfair advantage or free credits.

9. Prohibited Conduct: Account Misuse

Account credentials are for individual use only (or authorized team use on specific Enterprise plans). You may not share your login credentials, sell or transfer your account to a third party, or create multiple free-tier accounts to evade usage limits or circumvent bans (ban evasion).

10. API Specific Rules

Users of the TextileDesign API must ensure that their applications do not facilitate or allow their end-users to violate this AUP. You must implement reasonable safeguards, rate limiting, and reporting mechanisms in any application utilizing our API. We reserve the right to audit your API usage and immediately revoke access if your integration is found to be facilitating abuse.

11. Safety Filters and Moderation

TextileDesign employs a combination of automated safety filters (including prompt blocking and output analysis) and human moderation to enforce this AUP. You acknowledge that our automated systems may occasionally block benign prompts (false positives) or fail to catch violating content (false negatives). Attempting to "jailbreak" or intentionally circumvent these filters is a direct violation of this policy.

12. Enforcement Mechanisms

Violations of this AUP may result in various enforcement actions depending on the severity and context. These actions include: formal warnings, temporary suspension of generation privileges, forfeiture of purchased credits without refund, permanent account termination, blocking of IP addresses, and civil or criminal legal action.

13. Reporting Abuse and Violations

We rely on our community to help maintain a safe platform. If you encounter generated content or user behavior that violates this AUP, you are strongly encouraged to report it immediately. Reports can be submitted via the "Report" button on public images or by emailing support@cleverlyai.online with the subject "Report abuse". Please include links or relevant context.

14. Appeal Process

If you believe your account was suspended or your content was removed in error, you may submit an appeal to support@cleverlyai.online (subject "Appeal") within 30 days of the enforcement action. Our Trust and Safety team will review the appeal and make a final determination. We aim to respond to appeals within 7-10 business days.

15. Policy Updates and Modification

We reserve the right to modify this Acceptable Use Policy at any time to address new safety concerns, emerging AI capabilities, or legal requirements. Material changes will be communicated to users. Continued use of the Services following modifications constitutes your acceptance of the revised policy.
